Importing a vintage Lister 6/1 into the U.S.

We've known for a long time that the EPA prohibits importation of small diesel engines such as Listeroids.

 I am now told that the ban extends to vintage engines. I am trying to finalize a sale of my 6/1 start-o-matic engine to a buyer in the U.S.
He was told by customs that importation even of vintage engines is prohibited.

Does anyone have current information about this?

First I have heard of that.

After a little googling it looks like the "ancient engine" exemption was removed in 2023. That was the exemption for antique non-road use engines that allowed the import of original CS engines.

I am guessing that exemption which was intended for hobbyists and collectors was misused to import everything under the sun. That or the unchecked EPA under the previous administration cracked down on anything that didn't fall under their control.

What a pain!

Does your customer know if it includes vintage spare parts?

e.g. I know that the common Listeroid "workaround" was to sell them as "compressors" & then separately sell the bits to make them into a diesel engine again...

IMHO I wouldn't do that with a S-o-M - but if you split the engine & sent it as two separate (separate physically, and maybe a couple of weeks apart in time) consignments of "parts", maybe that would be a way to do it?

I've been poking around in the EPA regulations relating to stationary engines....what an arcane collection of rules! I would think that a customs inspector would not have much knowledge of the vagaries of these regulations, and would just say an ass-covering "no" to importation. After a lot of looking, I am not able to find much other then the "ancient engine exemption"  being eliminated in 2023. I will keep searching.

The idea of disassembly and sending the engine as parts is probably workable, though the freight (and associated) costs would be approximately double.
Part of the requirement is a heat treated pallet which I I had to build from properly marked dunnage: every piece has to be clearly marked . Scrounging up more material for another pallet is problematic.
It is quite regrettable that bureaucratic BS makes it nearly impossible for collectors and hobbyists to import and preserve these old machines.

I did discover that a non-conforming engine may be imported if it powers an armored vehicle with weapons installed.......
       I supposed the engine could be shipped in a welded up steel box with a BB gun duct taped on.

Unfortunate that there has been no interest here in Canada for a 6/1 start-o-matic. It's on the pallet and ready to ship, just not into the US.

While I agree that trying to figure out the regs requires a PHD in understanding government documents whoever led you to believe that engines produced prior to the diesel tier regulations cannot be imported was wrong. There is a steady stream of antique engines coming ashore in containers. Anyone who wants to spend what it takes to go that route I can hook them up without people who can get it it done once you find and get an engine bought across the pond.  I'm not sure why anyone would do that when for less money they can be found here but to each his own. A  $500 Lister CS located in England becomes a very expensive engine by the time its in someone's hands stateside. There is considerable interest in CS Listers among the Amish but they don't see on-line ads. This was the basis of my shop buisiness for years, while people were importing from England and buying Listeroids for $2000 I was buying CS engines from Amish for,, uuuh,, much less than that. If you advertise your CS in one of the several trade papers that circulate with the Amish community you will get responses, assuming someive in your part of the world.

I'm not across the pond, but in Canada, and only a few hundred miles north of the guy who wants to purchase my engine.
Good advice to try to advertise in an Amish paper.......there must be a few communities here, maybe back east.
If anyone can point me to a knowledgeable broker or the currently applicable EPA regs regarding importation of what they are calling "ancient engines", that would be most helpful

Well I finally read your entire post, sorry. The problem your buyer had with importation was calling it non-complient. Antique engines and pre-tier 1 diesels ARE complient because they are grandfathered. Customs gave him the correct answers for the question he asked.  Several years ago I imported an antique diesel generator set from not so far away from you from a museum in Langley BC. I contacted a Canadian trucking company named Caneda. They recommended a reasonably priced customs broker, I called them, answered a few questions and paid them like $100 for doing the paperwork. Caneda picked it up at Langley and held it in their ware house until it cleared customs and delivered it to my door for what I thought was an extremely reasonable price considering it weighs almost 3000 lbs. Best thing was it was near sux months before they sent me a bill, LOL

I am on the case and will contact the shipping company that you've linked.
The EPA  removed the "ancient engine" exclusion in 2023, so we will see what transpires. I do think there is a way, and can't imagine that they would not allow something like this, though these days it seems regs change quickly, frequently, and without a good reason.
I'm not ready to throw in the towel and you've given me a good lead.

Make sure you tell them it is for display and will not be used for prime power,,, that was one of the questions I was asked

As I read that ruling it appears that it applies only to engines going in off road vehicles. But,, again, all I know is antique engines are still coming in.

After making numerous requests for information, I finally got a reply from a company that's an EPA contractor handling these kinds of questions.
Looks like importation is allowed if you know the right box to check and the correct wording to use.

Here's what they wrote:


"Thank you for your inquiry. If the engine was manufactured in 1952, then it was built prior to the emission regulations starting and box 17 on form 3520-21 should be used.

The paperwork was successful!
The Start-O-Matic 6/1 arrived at it's destination.
British Columbia to N. Calif: 7 days door to door.

Now, anybody want to buy my 1964 BMW R-27?
